PokerNews x PokerStars NAPT 2024 Gold Pass Giveaway Competition Terms and Conditions ("Special Terms")

The following Special Terms form the information for the PokerNews x PokerStars NAPT 2024 Gold Pass Giveaway competition ("Competition")
THIS COMPETITION IS VOID WHERE PROHIBITED

  • 1. The promoters of the Competition are TSG Platforms (Ireland) Ltd (whose registered office is at Belfield Office Park, Beech Hill Road, Clonskeagh, Dublin 4, Dublin, D04 V972, Ireland) and iBus Media Limited (whose registered office is at 33-37 Athol St, Douglas, Isle of Man, IM1 1LB) ("Promoter", "we" or "us").
  • 2. By entering the Competition, participants ("Entrants"): (a) agree to be bound by these Special Terms and the general terms and conditions for promotions located at www.pokerstars.com/poker/promotions/terms ("General Terms") that apply to all promotions and competitions organised by the Promoter in connection with the PokerStars website located at www.pokerstars.com ("Site"); and (b) confirm that they meet all eligibility requirements for the Competition.
  • 3. In these Special Terms, a reference to “you”, “your”, “entrant” is a reference to the persons wishing to participate in the Competition and a reference to “winner” is a reference to the winner of the Competition.
  • 4. The Competition is not in conjunction with or tied to any other competition or promotions that may be running at the same time or other times.
  • 5. There is no entry fee and no purchase is necessary to enter the Competition.
  • 6. For residents of the United States, please note the arbitration provision set forth below, which requires, except where and to the extent prohibited by law, you to arbitrate any claims you may have against the Promoter on an individual basis. Arbitration on an individual basis means that you will not have, and you waive, the right for a judge or jury to decide your claims, and that you may not proceed in a class, consolidated, or representative capacity.
  • 7. Additional conditions apply, please read these terms and conditions in their entirety.

Who is eligible?

  • 8. Entrants must meet the eligibility requirements as specified in these Special Terms and the General Terms. Failure to meet the eligibility requirements may result in an entry being invalid and/or forfeiture of any prize.
  • 9. Entrants must be at least 21 years of age and be legal residents of the United States of America (excluding residents of the states of Washington, New York and Florida) (“US”). Proof of identification, age and address may be required at the request of the Promoter and the Promoter reserves the right to conduct any ID and security checks it sees fit to confirm Entrants comply with all eligibility requirements.
  • 10. The Promoter may request a copy of Entrants valid passport or other documents or information with respect to eligibility for the prize (e.g. in relation to visas). Entrants must supply these documents upon request and by the date specified by the Promoter. If this paragraph is not complied with, an Entrant will not be eligible for the prize and will forfeit the prize. The Promoter may then select an alternative winner using the selection procedure set out in paragraph 14.
  • 11. Entrants must not permit or allow another person to take part in the Competition on their behalf.
  • 12. Each Entrant is limited to up to four (4) entries as per the entry requirements outlined in clause 13 below and any entries submitted by the Entrant subsequent to their fourth entry will be disqualified.

How to qualify and how the Competition works

  • 13. In order to be eligible for the Competition, Entrants must:

    a. Listen to the PokerNews podcast and the Life Outside Poker podcast (“Podcasts”) between 12:01am PT on September 17 2024 and 11:59pm PT on October 13 2024 (“Entry Period”) and identify the code word in each podcast episode. There will be six (6) podcast episodes and six (6) code words to identify, and one (1) code word will be revealed in each podcast episode. Accumulated together the six (6) code words will reveal a code phrase (“Code Phrase”). The Podcasts are scheduled to be released on the following dates (such dates may be subject to change by Promoter):

    1. 17 September 2024 – Life Outside Poker - Niall Farrell
    2. 20 September 2024– PokerNews Podcast
    3. 27 September 2024 – PokerNews Podcast
    4. 01 October 2024 – Life Outside Poker - Maria Konnikova
    5. 04 October 2024 – PokerNews Podcast
    6. 11 October 2024 - PokerNews Podcast

    b. Submit the Code Phrase, along with their first name, last name, and email address to [email protected].The subject line of the email must state “Code Phrase”. Submitting the Code Phrase in accordance with the above criteria will provide the Entrant with one (1) entry and any entries submitted by an Entrant in accordance with the above criteria subsequent to their first entry will be disqualified. Entrants may be granted up to three (3) additional entries (“Bonus Entry”) by carrying out the following:

    a. Leaving a review for both Podcasts on Spotify (grants Entrant one (1) Bonus Entry); and/or
    b. Leaving a review for both Podcasts on Apple Podcasts (grants Entrant one (1) Bonus Entry); and/ or
    c. Following both podcasts on SoundCloud (grants Entrant one (1) Bonus Entry).

    The Bonus Entry/Entries will only be granted by the Promoter if the Entrant has submitted the Code Phrase via email in accordance with the above requirements and provided the Promoter with evidence (such evidence to be acceptable by the Promoter in the Promoter’s sole discretion) that they have left a review(s) as per the above requirements or followed both Podcasts on SoundCloud. The granting of the Bonus Entry/Entries is contingent upon the Entrant submitting the correct Code Phrase in accordance with the above entry requirements.

    Entries received outside the Entry Period will not be counted. This is the only entry route to the Competition and entries that do not comply with the provisions of this paragraph will not be eligible.

  • 14. Following the end of the Entry Period, the Promoter will select one winner from the pool of eligible entries via a Random Number Generator.
  • 15. The Promoter will notify the winner within 48 hours of winner selection via the email address that the Entrant submitted the Code Phrase from ("Notification"). The winner may also be announced on the Promoter’s social media and websites (“Announcement”) and by entering the Competition, Entrants acknowledge and agree that the Promoter is entitled to make the Announcement including their name.

Claiming your Prize

  • 16. To claim their prize, the winner must respond to the Notification within 48 hours confirming they wish to accept their prize.
  • 17. If the Promoter does not receive a response to the Notification from the winner within this timeframe, the relevant winner may forfeit their prize. The Promoter may then select an alternative winner using the selection procedure set out in paragraph 14.

The Prize

  • 18. The winner will win a prize consisting of one (1) Gold Pass to the PokerStars NAPT 2024 in Las Vegas, US., which entitles the winner to the following package:

    a. Buy-in to the $5,300 Main Event, due to take place from 5 – 10 November 2024;
    b. Seven nights hotel accommodation at Resort World – check in 4 November 20204 and check out on 11 November 2024 (worth up to $2,900); and
    c. $1,800 cash credit to be used to cover the cost of travel expenses incurred by the winner in getting to the PokerStars NAPT 2024. The cash credit can be collected by the winner in person at Resort World.

  • 19. Hotel accommodation shall be arranged by the Promoter.
  • 20. All travel plans (including but not limited to flights, airport transfers etc.) must be arranged by the package winner.
  • 21. The prize does not include any costs, taxes, fees, expenses and/or arrangements not expressly specified in the prize description. Each winner is solely responsible for, and the Promoter will not be liable to reimburse the winner/their companion for, any such additional charges and expenses.
  • 22. Travel arrangements together with the cost of getting to Las Vegas for the required dates, shall be the sole responsibility of the winner. Failure to secure proper documentation and authorisation for travel to the PokerStars NAPT 2024 will result in the forfeiture of the prize.
  • 23. Hotel accommodation dates cannot be amended or varied without incurring costs which shall be at the sole expense of the winner.
  • 24. It is the responsibility of the winner to check any requirements for the transport provider, hotel, and any other supplier providing elements of their prize. The winner is bound by, and must comply with, any terms and conditions set out on their travel tickets and the rules, regulations, requirements and policies of the transport provider, hotel, event promoter and any other supplier connected with their prize. The Promoter is not responsible for any failure of the winner to gain entry or re-entry to the transport or hotel, or to participate in any element of their prize, due to any action/inaction on the part of the winner.
  • 25. The Promoter has no liability for lost or stolen tickets, vouchers, certificates and/or other documentation connected with the prizes.
  • 26. All elements of the prizes are strictly non-transferable, non-exchangeable and may not be re-sold. No cash or any other alternative is available for any element of the prizes. No alternative dates are available.
  • 27. If any element of the prize becomes unavailable, or if a winner is unable to use/take part in any element of their prize, for any reason beyond the Promoter’s reasonable control, the Promoter is not obliged to offer an alternative prize or any cash alternative or compensation. If a winner is unable to attend the PokerStars NAPT 2024, the entire prize package will be forfeited and offered to another Entrant selected in accordance with paragraph 14.
  • 28. The winner must not do anything that may bring the Promoter, any of its group companies or its commercial partners into disrepute. The Promoter reserves the right to take appropriate action (including the removal of any element of the prizes) if the winner acts in a way that the Promoter reasonably considers to bring the Promoter, any of its group companies or its commercial partners into disrepute.
  • 29. The Promoter is not liable for any loss, theft, damage or injury caused or sustained by the winner as a result of participating in their prizes (except that the Promoter will be liable for death or personal injury arising from the Promoter’s negligence or for fraudulent misrepresentation).

What else do Entrants need to know?

  • 30. The Promoter reserves the right to disqualify an Entrant and forfeit their prize where the Promoter has reasonable grounds to believe there has been a breach of these Special Terms and/or the General Terms and/or any terms and conditions relating to participation in the tournaments and/or where an Entrant has gained unfair advantage in participating in the Competition and/or has used fraudulent means in connection with the Competition and/or the tournaments. The Promoter will be the final arbiter in any decisions, which will be final and binding and no correspondence will be entered into in this respect.
  • 31. The Promoter, its group companies and its agencies and contractors, shall not be liable for any problems or technical malfunction of any computer on-line systems, servers or providers, computer equipment or software, failure of any entry to be received on account of technical problems or traffic congestion on the internet or at any website, including any injury to or resulting from participation or downloading of any materials in the Competition.
  • 32. The Promoter reserves the right to amend, alter or terminate this Competition at any time without notice, including in the event of any actual or anticipated breach of any applicable law or regulation or in any other event outside of the Promoter’s control, and the Promoter shall have the right, at its sole discretion and at any time, to change or modify these Special Terms, and such change shall be effective immediately upon posting them on the Site.
  • 33. To the extent permitted by applicable laws, the Promoter does not accept any liability for any damage, loss, injury or disappointment suffered by any Entrant as a result of either participating in the Competition or not winning a prize.
  • 34. The information provided will only be used by the Promoter in connection with the Competition in accordance with the Privacy Policies available here and here.
  • 35. Any issues and questions concerning the construction, validity, interpretation and enforceability of these General Terms and/or Special Terms or the rights and obligations of US resident participants and the Promoter in connection with the Competition will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. You and we each agree to finally settle all disputes only through arbitration; provided, however, the Promoter will be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over you and us. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. You and we agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to the Competition shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within 14 days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in New York, New York. The federal or state law that applies to these Competition Terms will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York. We agree to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing). You or we may, notwithstanding this paragraph, bring qualifying claims in small claims court.
  • 36. The invalidity, illegality, or unenforceability of the whole or any part of the Special Terms does not affect or impede the continued validity, legality and enforceability of the remainder of the Special Terms.
